Acceptable Use Policy.

What may and may not be offered, sold, booked or posted on boukd, and what happens when someone crosses the line. Binding on every account, and read together with the Terms of Service.

1. Who this applies to

In short. Everyone. Bookers, bookables, event organisers, venues and anyone who posts. Breaking these rules can cost you your account and any money we are holding for a booking you were not entitled to.

boukd is a marketplace for booking people and places: performers, service providers, venues and events. This Policy applies to every account on the platform, to everything offered through it, and to everything posted on it. It forms part of the Terms of Service, and words defined there carry the same meaning here.

We apply this Policy to the substance of what is being offered, not to how it is labelled. Describing a prohibited service in neutral language does not make it permitted.

2. Businesses and goods we do not allow

In short. boukd is for lawful bookings of people, venues and events. The list below is not allowed at all, and no approval is available for it.

You may not use boukd to offer, advertise, book, sell or collect payment for any of the following:

  • Sexual services. Escorting, sex work, or any booking where a sexual act is part of what is being paid for. This is absolute and applies however the listing is worded.
  • Adult content. Pornography, nudity offered as a paid performance, or adult entertainment of any kind, whether live, recorded or streamed.
  • Controlled substances. Narcotics, psychotropic substances, and any drug controlled under the Narcotic Drugs and Psychotropic Substances (Control) Act, together with related paraphernalia.
  • Weapons. Firearms, ammunition, explosives, and their parts or accessories.
  • Gambling and betting. Casinos, sports betting, lotteries, raffles, prize draws, and anything else where a payment buys a chance of a return. This includes events whose main attraction is gambling.
  • Cryptocurrency and virtual assets. Exchange, trading, mining, custody, token sales, or accepting payment for any of these.
  • Financial services. Lending, deposit taking, money transfer, foreign exchange, debt collection, investment advice, insurance, and any arrangement that promises a financial return.
  • Pyramid and multi-level schemes. Chain referral schemes, matrix schemes, "get rich quick" programmes, and any offer whose return depends mainly on recruiting others.
  • Counterfeit and infringing goods. Replicas, unauthorised copies, and anything that infringes a trade mark, copyright or other right.
  • Human trafficking and exploitation in any form, and any content that sexualises a minor. We report these to law enforcement without waiting to be asked.
  • Stolen goods, and property the seller has no right to deal in.
  • Wildlife and protected species, including ivory, trophies and any product restricted under the Wildlife Conservation and Management Act.
  • Prescription medicines, medical devices and health claims offered without the licence the law requires.
  • Tobacco, nicotine products and alcohol sold as goods. Alcohol served at a licensed venue as part of an event is a different thing and is allowed where the venue holds the licence.
  • Hacking, surveillance and fraud tooling, including account credentials, card data, personal data sets, and services that defeat authentication.
  • Charitable fundraising on behalf of third parties. Donations through boukd support the operation of the platform itself and are described as such. We are not a fundraising channel for other causes.

3. Categories that need our written approval

In short. These are lawful but carry risk, so they are allowed only if you hold the right licence and we have approved you in writing.

The following may be offered only where you hold every licence, permit and registration the activity requires, you have given us evidence of it, and we have approved the account in writing:

  • Ticketed events with an expected attendance above 1,000 people, which require the relevant county and police approvals.
  • Events serving alcohol, where the venue must hold a current liquor licence.
  • Security personnel and crowd control services, which require registration under the Private Security Regulation Act.
  • Transport and chauffeur services, which require PSV licensing and insurance.
  • Childcare, tutoring and any service delivered to a person under 18, which requires the provider to satisfy our additional checks.
  • Catering and food service, which requires a public health certificate.
  • Medical, dental, legal, accounting and other regulated professional services, which require current professional registration.

Where a licence is required, we record its number and expiry against the account, and the listing is suspended when the licence lapses.

4. Prohibited conduct

In short. Be who you say you are, deliver what you promised, and keep the deal on the platform.

You may not:

  • Misrepresent who you are. This includes impersonating another person, business or brand, using someone else's identity documents, and presenting another person's work, photographs or credentials as your own.
  • List services you cannot deliver, or accept a booking you do not intend to honour.
  • Take the transaction off the platform. Asking a booker to pay you directly after meeting on boukd removes the protection the Hold gives them and removes our ability to help either side if something goes wrong. It is a ground for removal.
  • Manipulate ratings or reviews. This includes reviewing yourself, arranging reciprocal reviews, paying for reviews, and creating bookings that did not happen in order to generate them.
  • Harass, threaten, stalk or discriminate against anyone on the platform, including on the basis of ethnicity, gender, disability, religion or sexual orientation.
  • Circumvent enforcement. Creating a new account after removal, or operating an account on behalf of a removed user.
  • Attack the platform. Probing, scraping, overloading, reverse engineering, or attempting to access another person's account or data. Conduct of this kind may also be an offence under the Computer Misuse and Cybercrimes Act 2018.
  • Use another person's payment instrument without their authority.

5. Content standards

In short. Post your own work, keep it lawful, and do not put other people on the platform without their agreement.

Everything you post, including profile media, listings, posts, 24s, decks, livestreams and messages, must be lawful and must be yours to post. You may not post material that is obscene, that incites violence or hatred, that depicts a real person without their consent in a context they would object to, or that infringes another person's intellectual property.

Livestreams are held to the same standard as everything else, and being live is not a defence. We may end a stream without notice.

Rights holders may report infringement to [email protected]. We remove infringing material and repeat infringers lose their accounts.

6. Payment and financial abuse

In short. boukd is not a way to move money. Every payment here has a booking behind it.

Money on boukd moves for one reason: a booker pays for a booking, we hold it, and it is released to the bookable who delivered the work or returned to the booker. There is no wallet-to-wallet transfer between users, and there is no way to load a balance and send it to someone else.

You may not:

  • Create bookings that are not real in order to move money between accounts, extract funds from a card, or generate transaction history. We treat this as attempted money laundering and report it.
  • Structure payments to avoid a threshold or a check.
  • Use boukd to receive payment for anything other than the booking it is described as being for.
  • Dispute a card payment for a booking you received. This is chargeback fraud, and we supply the platform's records to the issuer.

We monitor for these patterns, we freeze funds where we see them, and we report suspicious activity to the relevant authority as the Proceeds of Crime and Anti-Money Laundering Act 2009 requires.

7. How we enforce this

In short. We match the response to what happened. Serious cases mean immediate removal. You can appeal, and money you had properly earned still reaches you.

Depending on what we find, we may do any of the following:

  • Remove a listing, a post or a stream.
  • Require verification before the account can trade again.
  • Limit an account, suspend it, or close it.
  • Cancel a booking and return the booker's money.
  • Withhold a release where we believe the booking was not genuine or the work was not delivered.
  • Report the matter to law enforcement or a regulator.

The first four categories in section 2, and any content sexualising a minor, result in immediate closure without a warning.

Money you properly earned remains yours. Closing an account does not entitle boukd to keep funds for bookings that were genuinely delivered. Where an account is closed, we settle what is owed once any investigation is complete, subject to any legal obligation preventing us from doing so.

Appeals. If you believe we have this wrong, write to [email protected] within 30 days. A person who was not involved in the original decision reviews it, and we reply in writing.

8. Reporting a violation

Report anything on the platform using the report control on the listing, profile, post or message, or write to [email protected]. Tell us what you saw and where, and include a link or a screenshot if you have one.

We acknowledge reports within two (2) working days and aim to resolve them within seven (7) working days. Reports of imminent harm, and any report involving a minor, are handled immediately and escalated to law enforcement where the law requires it.
